R.R.Q., 1981, c. S-5, r. 1, s. 338.
339. For the purposes of this Division, when a child is born outside Québec of a mother having the status of resident of Québec, he shall be deemed to be a resident of Québec.
R.R.Q., 1981, c. S-5, r. 1, s. 339.
340. The status of resident, once it has been acquired, is retroactive to the first day of the period of residence.
However, there shall be no retroactivity where a person who arrives in Québec had previous residence elsewhere in Canada. In such case, the status of resident of Québec is acquired with effect from the first day of the third month following the month of arrival.
Students from another province shall not be considered residents of Québec unless they prove that they have lost their eligibility as residents of their province of origin.
R.R.Q., 1981, c. S-5, r. 1, s. 340.

(e)  if he was absent from Québec for less than 12 consecutive months, while his family still resided or maintained a dwelling therein, in order to undertake temporary employment or execute a contract in another province or country, and he returns to Québec at least once a year or he informs the Minister of his inability to comply with this requirement;
(f)  if he is employed by a non-profit organization having its head office in Canada, and if he works abroad within the framework of an international aid or co-operation programme approved by the Minister of Health and Social Services.

342. Notwithstanding section 338, a foreign national as well as any of his dependents may acquire the status of resident during his stay in Québec and for the services he receives therein:
(a)  if he stays in Québec under an exchange programme approved by the Gouvernement du Québec and a foreign government, following an agreement between the Minister of Health and Social Services and the Minister of Immigration and Cultural Communities;
(b)  if he holds an employment visa issued by the Federal Department of Citizenship, Immigration and Multiculturalism and if he stays in Québec in order to hold an office or employment therein for a period of more than one year.
R.R.Q., 1981, c. S-5, r. 1, s. 342.
343. A person shall lose the status of resident:

344. Where a person who had the status of resident of Québec has left Québec for a period of more than 3 months but less than 12 months, the Minister shall refuse to reimburse the cost of services received if that person has taken up his residence outside Québec during such period.
R.R.Q., 1981, c. S-5, r. 1, s. 344.
345. Notwithstanding the foregoing, the period of stay in an establishment contemplated in this Division is not computed in calculating the time limit for obtaining the status of resident of Québec.
R.R.Q., 1981, c. S-5, r. 1, s. 345.
DIVISION VII
CONTRIBUTION OF BENEFICIARIES
346. An institution shall not require from beneficiaries, for accommodation or services to a person accommodated, in respect of which it receives financing out of the appropriations voted by the National Assembly, any rate or charge other than those prescribed in this Regulation, in the Youth Protection Act (chapter P-34.1) in the Hospital Insurance Act (chapter A-28) or in the Regulation made under this Act.
R.R.Q., 1981, c. S-5, r. 1, s. 346.
§ 1.  — Contributions for the placement of children
R.R.Q., 1981, c. S-5, r. 1, Part VI, Div. VII, sd. 1; O.C. 456-82, s. 1.
347. Except for section 355, this Subdivision applies to a minor.
R.R.Q., 1981, c. S-5, r. 1, s. 347; O.C. 456-82, s. 1.
348. Where a child is placed in a foster family or reception centre, the social service centre responsible for placing the child, or any other social service centre acting on its behalf, shall require a contribution in accordance with this Subdivision.
R.R.Q., 1981, c. S-5, r. 1, s. 348; O.C. 456-82, s. 1.
349. For a new placement, no contribution is required for the first 30 days.
However, if a child is placed more than once during a 12-month period, the exemption provided for in the first paragraph applies only to the first placement unless the latter lasts less than 30 days, in which case the first 30 days of exemption may be completed on a subsequent placement.
R.R.Q., 1981, c. S-5, r. 1, s. 349; O.C. 456-82, s. 1; D. 2076-82, a. 2.
350. The contribution is payable on a monthly basis, on the first day of each month, for the month elapsed.
The monthly contribution required is the amount obtained by using, according to the age category to which the placed child belongs, the daily rate payable to a foster family on the first day of January preceding the day on which the contribution is paid, in accordance with the Order in Council* made under section 153 of the Act, for taking charge of a child in that category, and by multiplying the daily rate by 20.
Where the daily rate payable to a foster family changes during the year, the new rate shall be used to determine the monthly contribution required.
In determining the age category of the placed child for the purposes of this section, only the day on which the child is placed and the first day of January of each year subsequent thereto are taken into account.
*See the Regulation respecting the classification of services offered by family-type resources and the rates of compensation applicable of each type of service (chapter S-4.2, r. 2).
R.R.Q., 1981, c. S-5, r. 1, s. 350; O.C. 456-82, s. 1; O.C. 1728-91, s. 1; O.C. 288-92, s. 1.
351. The monthly contribution is paid out of the child’s father or mother’s personal income.
R.R.Q., 1981, c. S-5, r. 1, s. 351; O.C. 456-82, s. 1; O.C. 1728-91, s. 2; O.C. 1117-2001, s. 1.
352. The monthly contribution payable pursuant to this Subdivision is reduced proportionally for each day during the month a child spends with his father and mother, and for each day on which a child, because of his running away or being hospitalized, is not sheltered.
For the purposes of this section, the word “day” means a period of at least 7 consecutive hours during the same day.
R.R.Q., 1981, c. S-5, r. 1, s. 352; O.C. 456-82, s. 1; O.C. 1117-2001, s. 2.
353. Where a father and mother who are bound to pay a contribution are Québec residents, they may apply to be partially exempted from paying the contribution in accordance with section 354 by producing, at the social service centre, an application for exemption in accordance with the Form in Schedule V.
The first paragraph also applies to a father and mother who are not Québec residents but whose child is placed in a foster family or in a reception centre in Québec on the express request of a recognized placement organization in another province or territory of Canada.
R.R.Q., 1981, c. S-5, r. 1, s. 353; O.C. 456-82, s. 1; O.C. 1728-91, s. 3.
354. An application for exemption is accepted by the social service centre where the contribution income of the father and mother determined in accordance with section 355 is less than 6 times the aggregate amount they are required to pay annually pursuant to section 350.
However, if the father and mother are not entitled to an exemption, their application is deemed to have been refused on the day on which the child was placed.
R.R.Q., 1981, c. S-5, r. 1, s. 354; O.C. 456-82, s. 1.
355. The contribution income of a father and mother who have applied for an exemption is computed by adding to the income of the father and mother determined in accordance with section 28 of the Taxation Act (chapter I-3), for the last calendar year, any non taxable indemnity, pension, annuity, allowance or benefit from any source.
The following annual amounts are exempted from the amount computed pursuant to the first paragraph for dependents not placed in a foster family, reception centre, hospital centre for prolonged care or an institution offering these services:
(a)  $19,741 in cases where at least 2 adults live together, or $13,532 if there is only one adult;
(b)  $5,413 for each minor;
(c)  $6,740 for each person who has attained his majority and attends an educational institution on a full-time basis.
The exemptions in the second paragraph are indexed on 1 January each year according to the Pension Index established pursuant to section 117 of the Act respecting the Québec Pension Plan (chapter R-9). They are rounded to the nearest dollar.
A person may be considered dependent only if he has no income or if his income is less than the exemption to which he is entitled.
R.R.Q., 1981, c. S-5, r. 1, s. 355; O.C. 456-82, s. 1; I.N. 2020-12-10; O.C. 1281-2020, s. 5.
356. If a father and mother claim that, subsequent to a retirement or an event such as death, illness, or loss of employment, their income will be less for the current calendar year than for the preceding year, they may attach to the form an account of the reasons justifying their claim; in determining the contribution income, their decrease in income and the duration of the event, where applicable, are taken into account.
R.R.Q., 1981, c. S-5, r. 1, s. 356; O.C. 456-82, s. 1.
357. A father and mother who benefit from an exemption must pay only 1/72 of their annual contribution each month, regardless of the number of children placed, subject, however, for each child placed, to a minimum monthly amount established in accordance with the following formula:
_ _

B x C
A + | _______ |

12
_ _
___________________

C
where
A = the total family assistance allowances, except for allowances for newborn children and allowances for handicapped children that have not been placed, the amounts of which were in force on the first day of August 1997;
B = tax credits from all sources for children provided for in the Income Tax Act (R.S.C. 1985, c. 1, 5th Suppl.) and in the Taxation Act (chapter I-3) and in force on the first day of January 1997;
C = the number of children in the family for whom a child tax benefit and family assistance allowances have been established in accordance with A.
The minimum monthly amount determined under the first paragraph shall not exceed the amount of the contribution required under section 350.
R.R.Q., 1981, c. S-5, r. 1, s. 357; O.C. 456-82, s. 1; O.C. 1728-91, s. 4; O.C. 1757-92, s. 1; O.C. 1051-97, s. 1.
357.1. (Obsolete).
O.C. 456-82, s. 1.
357.2. A father and mother who benefit from an exemption must reapply therefor to the social service centre each year and must notify the latter without delay of any change which may alter their eligibility to such an exemption or alter the computation of the contribution to be paid.
O.C. 456-82, s. 1.
§ 2.  — Contribution of adults accommodated
358. A reception centre or a hospital centre in which an adult is accommodated shall require from the latter a per diem contribution for his accommodation, calculated under this Subdivision.
R.R.Q., 1981, c. S-5, r. 1, s. 358; O.C. 1426-84, s. 1.
358.1. The per diem is payable from the first day an adult is accommodated:
(a)  in a homecare centre, a hospital centre for long-term care or an institution offering such services;
(b)  in a rehabilitation centre for the physically handicapped or a rehabilitation centre for the mentally handicapped;
(c)  in a rehabilitation centre for the socially handicapped or a rehabilitation centre for mothers with adaptation problems where the beneficiary has reached the age of 18;
(d)  in a hospital centre for short-term care where a beneficiary has been discharged under section 4 of the Act but his condition does not allow his return home and a place must be found for him in an institution described in paragraph a, b or c of this section.
O.C. 1426-84, s. 2.
358.2. The per diem is payable after an adult has been accommodated for 45 days:
(a)  in a rehabilitation centre for drug addicts; and
(b)  in a hospital centre for short-term care, except where the attending physician or a specialized nurse practitioner certifies in the beneficiary’s medical record that active care is still required because of a particular pathology and repeats his certificate every 30 days thereafter.
O.C. 1426-84, s. 2; O.C. 21-93, s. 1; O.C. 22-93, s. 2; S.Q. 2020, c. 6, s. 86.
359. The daily rate payable to a reception centre shall be equal to the estimated operating cost of the centre including the depreciation of capital assets, the cost of medication and the cost of nursing services, divided by the probable annual number of days of stay. The cost of external services, however, shall not be considered in determining the rate.
R.R.Q., 1981, c. S-5, r. 1, s. 359.
360. The per diem payable to a hospital centre for an adult who is a Québec resident shall be $65.54 for a private room, $54.75 for a semi-private room and $40.79 in every other case.
The amounts referred to in the first paragraph are indexed on 1 January each year according to the Pension Index established pursuant to section 117 of the Act respecting the Québec Pension Plan (chapter R-9).
For the purposes of this Subdivision, a “Québec resident” is understood as a person who is residing in Québec or who is residing in Québec temporarily within the meaning of sections 5 to 8 of the Health Insurance Act (chapter A-29).
R.R.Q., 1981, c. S-5, r. 1, s. 360; O.C. 3411-81, ss. 1 and 2; O.C. 1426-84, s. 3; O.C. 967-90, s. 1; O.C. 1800-90, s. 1; O.C. 288-92, s. 2; O.C. 847-96, s. 1; O.C. 576-2001, s. 1; I.N. 2020-12-10; O.C. 1281-2020, s. 6.
360.1. Notwithstanding anything to the contrary in this Subdivision, the following persons must pay, from the first day, the per diem published by the Minister and determined on the basis of estimates of expenses and income, taking into account the days of stay for the period in question:
(a)  an adult accommodated in a hospital centre who is not a Québec resident;
(b)  an adult who, under section 4 of the Act, has been discharged and whose condition allows his return home or for whom a place is assured in another institution but who refuses to leave the institution accommodating him; and
(c)  a third party responsible for damages necessitating the accommodation of an adult or whose duty, under a statute of Québec, Canada or any other jurisdiction, is to be responsible for the cost of services provided to an accommodated adult.
O.C. 1426-84, s. 4.
361. The daily rate is invoiced every month, before the beginning of the month, at 30 times its amount, to fix the monthly rate payable by the adult. If the accommodation period is less than 30 days, the rate shall be invoiced pro rata to the days of stay which remain.
The day from which the contribution is or becomes payable is considered a day of stay but that on which the beneficiary leaves is not counted. Periods of temporary discharge from a hospital centre or a reception centre are counted as days of stay.
R.R.Q., 1981, c. S-5, r. 1, s. 361; O.C. 1426-84, s. 5.
362. An adult whose contribution income less income tax is less than the monthly rate which he has to pay shall benefit from an exemption from payment equal to the difference between such rate and such income.
R.R.Q., 1981, c. S-5, r. 1, s. 362.
363. The contribution income is calculated according to the following formula:
Where: Contribution income = (A + B) - C
A = Family income established in keeping with the provisions of section 363.1;
B = Increase for property established in keeping with the provisions of section 363.2;
C = Sum of the deductions granted in keeping with the provisions of section 363.3.
Where the result is negative, the income contribution is nil.
Notwithstanding the provisions of sections 363.1 to 363.3, the following factors must not be taken into consideration for the purpose of establishing the contribution income:
(1)  the presence of a spouse or a child with respect to whom a contribution may be required pursuant to section 159 of the Act or section 512 of the Act respecting health services and social services (chapter S-4.2) as a beneficiary or user who is accommodated in an institution referred to in one of these statutes or who is taken in charge by a resource referred to one of these statutes;
(2)  the benefit to an adult consisting in relief in whole or in part from payment for his accommodation;
(3)  the amount of the benefit received under a last resort assistance program in accordance with the Individual and Family Assistance Act (chapter A-13.1.1) as well as the interest produced by the liquid assets of the accommodated adult and his spouse, if applicable, whose value does not exceed the exclusion amounts set out in the first paragraph of section 369;
(4)  the expenses incurred to maintain a dwelling or residence;
(5)  the payments referred to in paragraph 29 of section 111 of the Individual and Family Assistance Regulation (chapter A-13.1.1, r. 1), up to the maximum amount set out therein.
R.R.Q., 1981, c. S-5, r. 1, s. 363; O.C. 3411-81, s. 3; O.C. 1426-84, s. 6; O.C. 1039-89, s. 1; S.Q. 2011, c. 18, s. 316; I.N. 2020-12-10; O.C. 1281-2020, s. 8.
363.1. Family income includes the income of the adult and that of his spouse, if applicable, for the preceding month, within the meaning of section 28 of the Taxation Act (chapter I-3), as well as any non-taxable indemnity, pension, annuity, allowance or benefit arising from any source whatsoever.
O.C. 1281-2020, s. 8.
363.2. The increase for property is equal to 1% of the amount by which the value of the property of the accommodated person and his spouse, if applicable, exceeds $5,000 if the accommodated adult has a dependent spouse or child, and $2,500, in all other cases.
For the purpose of calculating this increase, the total value of the property is determined in accordance with sections 145, 146, excluding paragraph 2, 148 and 150 of the Individual and Family Assistance Regulation (chapter A-13.1.1, r. 1), given the necessary adaptations and excluding the total value of the following property from the calculation of the increase:
(1)  the value of a residence or farm during the longer of the following periods:
(a)  a period of one year from the time when a contribution may be required of the adult pursuant to section 159 of the Act, as a beneficiary who is accommodated in an institution;
(b)  the period during which the dependent spouse or child of the accommodated adult lives in or operates this residence or farm on a continuous basis;
(2)  the capital from an indemnity paid as compensation for immovable property following an expropriation, fire or other disaster, act of war, attack or criminal act if it is used in the 2 years following its receipt for the repair or replacement of this property or for the operation of an enterprise;
(3)  the capital from the sale of a residence if it is used to purchase a new one or have a new one built within 6 months of the sale;
(4)  the capital from an indemnity paid as compensation for movable property following a fire or other disaster, act of war, attack or criminal act if it is used within 90 days of its receipt;
(5)  the value of the property used within the scope of self-employment or the operation of a farm.
Notwithstanding the first paragraph, with respect to the property referred to in subparagraphs 1 to 3 of the second paragraph, the increase for property applicable at the end of the time periods set out therein is equal to 1% of the amount by which the total value of the property exceeds the amount provided for in the first paragraph of section 164 of the Individual and Family Assistance Regulation. As well, with respect to automobiles, the increase for property is equal to 1% of the amount by which the value of these automobiles exceeds $10,000.
O.C. 1281-2020, s. 8.
363.3. The following monthly deductions are granted to an accommodated adult in the cases and conditions indicated:
(1)  $1,265 where the accommodated adult has a spouse;
(2)  $506 for each dependent child under age 18;
(3)  $635 for each dependent child age 18 or over who is attending an educational institution full time;
(4)  $273 as a personal expense allowance, where the deduction set out in subparagraph 1 is not granted to the accommodated adult;
(5)  a deduction for the payment of the rent indicated in the lease of the dwelling that the accommodated adult was occupying before his admission to an institution and which he is required to fulfil, up to the portion of the monthly lease assumed by this adult. For the purposes of determining the rent that the adult is required to pay, services other than those referred to in the provisions of the third paragraph of section 1974 of the Civil Code are not taken into consideration. This deduction may be granted only for the first two contribution months on presentation of documents establishing the obligation to continue paying rent and the amount to be paid.
The amounts referred to in subparagraphs 1 to 4 of the first paragraph are indexed on 1 January of each year on the basis of the Pension Index established in accordance with section 117 of the Act respecting the Québec Pension Plan (chapter R-9). They are rounded to the nearest dollar.
O.C. 1281-2020, s. 8; O.C. 1282-2020, s. 1.
364. The contribution income less income tax represents the amount obtained after having deducted from the contribution income determined in conformity with section 363 the amount of income tax which the adult and his spouse not accommodated would have to pay if they were paying such tax on a monthly basis.
R.R.Q., 1981, c. S-5, r. 1, s. 364.
365. The adult who must pay a monthly rate may, in addition to the exemption he benefits from under section 362, be granted a supplementary exemption if he is in one of the situations referred to in section 366 or 368.
R.R.Q., 1981, c. S-5, r. 1, s. 365; O.C. 1281-2020, s. 9.
366. The Minister shall grant a supplementary exemption to the adult who does not benefit from any of the deductions referred to in subparagraphs 1, 2 and 3 of the first paragraph of section 363.3 if his contribution income is less than twice the monthly rate that he has to pay.
The exemption referred to in the first paragraph is then equal to the difference between the amount which the adult would be exempt from paying, in accordance with section 362, if he only had to pay one-half of his contribution income as monthly rate, and the amount for which he is actually benefiting from an exemption under this section.
R.R.Q., 1981, c. S-5, r. 1, s. 366; O.C. 1281-2020, s. 10.
367. For the purposes of section 366, the contribution income of an adult who draws any benefit under the Old Age Security Act (R.S.C. 1985, c. O-9) is determined by adding the amount by which the maximum benefit payable under the Act exceeds the personal expense allowance prescribed in subparagraph 4 of the first paragraph of section 363.3.
R.R.Q., 1981, c. S-5, r. 1, s. 367; O.C. 1426-84, s. 7; O.C. 1281-2020, s. 11.
368. The Minister shall grant a supplementary exemption to the adult who benefits from one of the deductions referred to in subparagraphs 1, 2 and 3 of the first paragraph of section 363.3 if his contribution income is less than four times the monthly rate that he has to pay.
The exemption referred to in the first paragraph is then equal to the difference between the amount which the adult would be exempt from paying, in accordance with section 362, if he only had to pay 1/4 of his contribution income as monthly rate, and the amount for which he is actually benefiting from an exemption under this section.
R.R.Q., 1981, c. S-5, r. 1, s. 368; O.C. 1281-2020, s. 12.
369. The amount of the exemption granted to an accommodated adult is reduced by the amount by which the value of his liquid assets and those of his spouse, if applicable, exceed $5,000, if the accommodated adult has a dependent spouse or child, and $2,500, in all other cases.
Subject to section 369.1, the total value of the liquid assets is determined in accordance with sections 128 and 129 of the Individual and Family Assistance Regulation (chapter A-13.1.1, r. 1), taking into consideration the necessary adaptations.
Notwithstanding the first paragraph, in the case of an adult whose accommodation predates 1 July 1975, the amount by which the value of his liquid assets and those of his spouse, if applicable, exceeds the exclusion amounts referred to therein is added instead to the value of his property for the purposes of the provisions of section 363.2.
R.R.Q., 1981, c. S-5, r. 1, s. 369; O.C. 1426-84, s. 8; O.C. 1039-89, s. 2; O.C. 1157-2001, s. 1; O.C. 181-2007, s. 1; O.C. 1281-2020, s. 13.
369.1. For the purposes of section 369, the following amounts are not taken into consideration when establishing the total value of the liquid assets:
(1)  the value of the sums referred to in sections 135 and 136 of the Individual and Family Assistance Regulation (chapter A-13.1.1, r. 1);
(2)  the value of the sums paid out pursuant to the judgment rendered by the Superior Court on 28 May 2013, confirming the agreement following the class action on behalf of users of résidence St-Charles-Borromée (CHSLD Centre-Ville);
(3)  the value of the sums paid out pursuant to the judgment rendered by the Superior Court on 23 April 2014, confirming the agreement following the class action on behalf of the users of 89 residential and long-term care centres with respect to the laundry service for their personal garments;
(4)  the value of the sums paid out pursuant to the judgment rendered by the Superior Court on 9 September 2014, confirming the agreement following the class action on behalf of users of hôpital Rivière-des-Prairies;
(5)  the value of the sums paid out pursuant to the judgment rendered by the Superior Court on 15 May 2015, confirming the agreement following the class action on behalf of users of centre hospitalier régional du Suroît de Valleyfield;
(6)  the value of the sums paid out in 2015 by Centre d’hébergement et de soins de longue durée (CHSLD) Jeanne-Le Ber to users of this centre, toward the reimbursement of financial losses resulting from irregular operations into their bank accounts;
(7)  the value of the sums paid out pursuant to the settlement agreement, approved by the Federal Court in June 2018, following the class action filed on behalf of members of the Canadian Armed Forces, members of the Royal Canadian Mounted Police and employees of the federal public service having suffered prejudice due to their sexual orientation, gender identity or gender expression;
(8)  the value of the sums paid out pursuant to the judgment rendered by the Federal Court on 30 January 2019, confirming the settlement agreement following the class action filed on behalf of war veterans receiving various benefits, including a disability pension;
(9)  the sums accrued in a registered retirement savings plan, where the holder of the plan has not reached the age of eligibility for a full pension under the Old Age Security Act (R.S.C. 1985, c. O-9);
(10)  the sums accrued in a registered disability savings plan, including those paid into it in the form of Canada disability savings bonds or Canada disability savings grants for the benefit of the adult, his spouse or one of his dependent children and which he cannot dispose of in the short term without incurring a penalty, according to the rules applicable to that plan.
The exclusions set out in subparagraphs 1 to 8 of the first paragraph apply as of the date of payment of these sums and only for the person who is entitled thereto.

371. The Minister shall grant, upon application of the adult accommodated in a reception centre, regardless of section 369 and the increase for property referred to in section 363.2, a supplementary exemption equal to the difference between the monthly rate payable to the reception centre less the exemption and the monthly rate that he would pay if he were accommodated in a hospital centre.

374. An application for exemption must be addressed to the Minister using the appropriate form supplied to this end.
